I have decided to sell my house without using a real estate agent to save on commission fees. While I have a potential buyer lined up already, I am feeling a bit overwhelmed by the actual legal paperwork required to finalize the transaction. Does anyone know exactly which documents are mandatory for a private sale to ensure everything is legally binding? I want to make sure I don't miss anything important that could cause issues during the closing process. Any advice or a checklist would be greatly appreciated.

Honestly, you really need a real estate attorney. Do not try to DIY the deed transfer unless you have legal experience.

I agree with the first comment. Saving on commission is great, but a mistake on the title or deed will cost you way more than 6% in the long run.

You will need a Purchase Agreement, a Property Disclosure form, and the Deed. Everything needs to be notarized.

Don't forget the title insurance! Most buyers won't even close without it, and you'll need a title company to facilitate that.

Check your local state laws, they vary wildly. Some states require a lawyer, others just a notary.

Exactly, I did a FSBO in Florida and it was surprisingly straightforward with a title company handling the escrow.

Are you sure you want to risk it? The buyer might be trying to pull a fast one if they haven't mentioned a title company yet.

What about the property tax proration? You need a solid spreadsheet to calculate what you owe vs what the buyer owes at closing.

I second the motion for a real estate lawyer. It only cost me about $800 to have one review all the docs and handle the closing.

Is the buyer using a mortgage? If so, their bank will demand a specific set of documents and an appraisal, so you won't be doing it alone.

Exactly, the lender will essentially force the paperwork through their own channels. It's much easier than a cash sale.

Keep a paper trail of every single email and text message you exchange with the buyer. Just in case.

Just hire a closing agent. They do this all day every day and they aren't that expensive compared to an agent's commission.
