I'm currently looking into subletting my spare room for a few months while I travel, but I'm a bit confused about the legal side of things. I've heard that I need written permission from my landlord, but I'm not sure what specific clauses to look for in my lease agreement. Does anyone know if there are standard state laws that protect me, or is it entirely up to the landlord's discretion? I really don't want to accidentally violate my contract and face an eviction notice. Any advice on how to draft a sublease agreement or what questions I should ask my landlord would be greatly appreciated.

First thing you need to do is read your lease cover to cover. Most contracts have a specific section titled 'Subletting' or 'Assignment' that dictates the rules.

Exactly what @user1 said. If your lease says you need written consent, do not skip that step. My landlord was super chill about it once I explained the situation, but he still required a formal addendum.

It’s really not up to state law in most places; it’s almost entirely contractual. If the lease says 'no subletting,' you are usually out of luck unless the landlord agrees to an exception.

To add to that, even if they agree, they can charge you a 'processing fee' for the paperwork in some states. Check your local tenant rights website, they often have PDFs of standard sublease agreements.

I sublet my place last summer. I made sure to meet the person, check their references, and then forwarded all that info to my landlord. It made him feel way more comfortable approving it.

That's a great tip. Providing a vetted candidate definitely increases your chances of getting a 'yes'.

Whatever you do, don't just 'under-the-table' sublet it. If the subtenant stops paying or causes damage, you are 100% legally liable for the rent and repairs. It's a huge risk.

Totally agree with @user7. You are essentially the landlord to your subtenant. Make sure you get a security deposit from them too, just in case.

Try searching for your state + 'sublease agreement template.' There are plenty of reputable real estate sites that offer free basic forms you can fill out.

Don't forget to check your local rent control laws if you live in a big city. Sometimes there are specific rules about how much you can charge for rent when you sublet.

In some rent-stabilized units, you legally cannot charge more than your own rent plus a small percentage for utilities/furniture. Definitely look that up so you don't get in trouble.

This whole process is such a headache. Honestly, I decided it wasn't worth the stress and just left the room empty for the three months I was gone.
